As a legally trained HR Practitioner, we produce high quality drafting relating to the IR/ER matter you are currently managing that complies with industrial relations legislation.

We specialise in drafting policies and procedures, submissions to claims, contracts of employment, deeds of release and settlement and any other correspondence relating to performance management or grievance resolution.

PROTECTION

We provide auditing services to provide an objective assessment of your existing policies and procedures to ensure compliance with employment laws. We draft policies that represent best practice and are tailored to your business or we can amend your existing policies to ensure compliance.

Our compliance activities also include a review of your business’s compliance with modern award provisions. We are able to review the terms of your employment contracts to ensure compliance with modern award terms.


WORK HEALTH AND SAFETY

WHS Issue Resolution and Advice

If your business requires external input or advice to address a safety concern, our Workplace Health and Safety team are available to assist. Advice can be provided on how to best respond to and manage an incident or hazard, or how to best approach an issue which may have been identified.  

WHS Governance Framework Design and Assessments

Many workplaces face significant barriers in establishing an effective governance framework for safety management. Caris Consulting offers experienced insight into WHS governance framework design and may assist you in either identifying the areas for improvement in your existing structure, as well as propose alternative structures which meet legislative requirements. 

Safety Management System Assessments, Design and Drafting

We provide services to assess your existing systems (gap analysis) against relevant legislative requirements and offer packages to design reimagined safety management systems which best fit your business model. Where required, Caris Consulting may assist in drafting high level components of your safety management system. 

WORK PLACE INVESTIGATIONS

We have a team of licensed and experienced workplace investigators who are trained to provide reliable, timely, thorough and impartial investigative services to your workplace issue. Our investigations are of a high quality that can withstand scrutiny by a court of law.  

We investigate all matters relating to misconduct, grievances and workplace bullying issues in the workplace. With pride ourselves on providing our clients with a complete service. Our Investigators will investigate your issue and provide findings of fact whilst our team of IR/ER Practitioners will partner with you to implement HR recommendations.  


NEGOTIATION OF ENTERPRISE AGREEMENTS

Negotiating enterprise agreements under the Fair Work Act requires a specialist and technical skillset. We have a track history of successfully negotiating enterprise agreements for our clients allowing them to focus on their core business. We can either support your existing HR team or if you don’t have a HR team, we will partner with you to assist all aspects of the negotiations including: 

  • Understanding the needs of your business which will enable us to develop your log of claims.
  • Drafting of forms to meet the technical requirements under the Act including the Notice of Employee Representational Rights, forms 16 and 17. 
  • Facilitate negotiation meetings with your employee and union representatives in line with good faith bargaining principles. 
  • Providing strategic advice and negotiation.
  • Conducting award/agreement salary comparisons to provide you with the assurance that your proposed agreement stands to pass the Better off Overall Test.
